Master Builders Australia has updated the standard form Construction Management and accompanying Trade Contract.

The contracts have been updated to reflect new harmonised occupational health and safety legislation, to include provisions for service by email and to reflect improved dispute resolution practices.

Chief Executive Officer, Wilhelm Harnisch, said the updated contracts help ease the paperwork burden for builders and contractors and should facilitate the expert management of construction work.

"The Construction Management contract outlines the terms for principals who engage a construction manager to act as their agent to monitor and control the project through construction programs and budgeted cost plans.

"The Trade Contract can be used for all trade contractors connected with the project. It sets out the terms and conditions on which the construction manager engages trade contractors on behalf of a principal.

Mr Harnisch suggests the pro forma contract should be entered into as early as possible after design drawings have been commissioned by the principal or even at the stage of completion of draft design drawings.

“This is so the Construction Manager can assess the "buildability" of the project. Construction Managers will prove their worth by helping to create the most cost effective design that will benefit the principal, designers and trades consultants," Mr Harnisch said.
